Pet policy

  1. Residents of Freeman’s Park are permitted to keep a pet only if they have completed and submitted the application form, and obtained the permission of the Body Corporate. Any person wishing to keep a pet must obtain the approval of the Body Corporate prior to bringing their pet on site. If a tenant would like to keep a pet in the unit they are renting they will be required to have approval of the owner/landlord first and will have to ask that the owner/landlord obtain permission on their behalf.

  2. Owners wishing to keep pets (other than cats and dogs) that are kept in cages, tanks etc. and which will remain in a resident’s unit are not required to obtain the Body Corporate’s consent.

  3. All other pets require the Body Corporate’s prior permission. If in doubt about whether you need permission please discuss your plans with the Building and Grounds Manager.

  4. Guide Dogs are not considered pets. If a resident has a Guide Dog they must advise the Body Corporate of this fact.

  5. Pets must be kept inside a resident’s unit and/or accessory unit unless it is being exercised by their owner. Dogs are not permitted to roam and must be on a lead at all times outside their unit. This requirement means that the Body Corporate is interested to know what sort of breed an applicant intends to keep as a pet. Pets that bark, cry or whine while alone inside a unit are not considered suitable for a unit title property.

  6. [Repealed].

  7. No pet is permitted to roam inside apartment buildings in halls and stairwells.

  8. Any fouling by pets on common property must be cleaned up immediately by the owner.

  9. No resident or owner is permitted to install a cat door in starblock units as these breach fire regulations.

  10. All approved pets must wear a tag that identifies their address.

  11. Requests to keep a pet must be made in writing to the Body Corporate, using the approved application form. Incomplete requests will not be considered. All requests must provide the following information:

    • the type, breed, age and number of the pets you are requesting to keep, with a photo of each pet

    • its suitability for your location. It is ideal to enclose independent information or evidence of this

    • a statement saying that the pet will be kept in your unit/accessory garden unit at all times unless it is being formally exercised by you

    • a statement saying that you understand that the pet will not be permitted to roam on common property and that dogs will be leashed at all times outside of the owner’s unit

    • a statement confirming that the pet, if approved, will always wear a tag identifying its address

    • proof that cat or dog is neutered.

  12. Requests to keep a pet are assessed on an individual basis. If the Body Corporate considers that an area or block is home to a particular number of pets it may decline any further requests for a pet.

  13. The Body Corporate may require a reference from a previous neighbour to establish if a pet is suitable for a unit title property. 

  14. The Body Corporate reserves the right to rescind any permission granted if complaints regarding an approved pet are received.

Operational Rules: Pets

18. Pets

a. An Owner must not, without the prior written consent of the Body Corporate, bring or keep any animal or pet in or on any Unit, unless the animal or pet is a reasonable number of fish or one small bird in which case it is permitted and Body Corporate consent is deemed to have been given. Consent of the Body Corporate shall not be unreasonably or arbitrarily withheld but may be revoked upon written notice if the rights or interests of any other Owner are adversely affected by any animal or pet, including any fish or small bird permitted under this rule.

b. Notwithstanding rule 18.a any Owner of a Unit who relies on a "disability assist dog" under the Dog Control Act 1996 (or any replacement legislation), may bring the disability assist dog into the Unit and the common property, on the condition that adequate evidence is provided at the Body Corporate's request that the dog is a registered "disability assist dog", and it is on a leash when moving around Freemans Park.

c. If required by the Body Corporate, an Owner must supply and keep updated information about animals and pets living at Freemans Park such that the Body Corporate may maintain a register of pets. This information shall include a photo of the animal or pet for identification purposes, and any other information reasonably requested, and in order to show compliance with these rules.

d. An Owner must not bring or keep in any Unit or on the common property any dog that belongs wholly or predominantly to a breed or type listed in Schedule 4 of the Dog Control Act 1996 (or any replacement legislation), being breeds or types classified as menacing or prohibited in New Zealand. This prohibition applies regardless of whether the dog is registered, muzzled, or subject to any special permit.

e. An Owner must not keep any cat and/or dog in a Unit unless that animal has been neutered, and evidence of that neutering has been provided to the Body Corporate, and such prior written consent to the cat or dog has been obtained under rule 18(a) (subject to rule 18(b)).

f. An Owner must ensure that any dog on the common property is on a leash, unless that dog is on part of the common property that has been designated an off-leash exercise area.

g. To reduce the risk to birds and other wildlife on the common property, an Owner must not keep any cat in a Unit unless that animal wears a brightly coloured collar with a bell that makes a noise when the animal is moving and prior written consent to the cat has been obtained under rule 18(a).

h. The Owner of any animal or pet permitted under 18(a) or any dog permitted under rule 18(b) must ensure that any part of a Unit or the common property that is soiled or damaged by the animal, pet or dog must promptly be cleaned or repaired at the cost of the Owner.

i. An Owner must not keep any animal or pet on the common property.
